Welcome to SokCurl™
By purchasing and/or using SokCurl™ products, you (“User,”“Purchaser,” or “You”) agree to be bound by the following Terms of Use. These terms are designed to promote safe usage and protect the legal integrity of our brand.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE OR USE THE PRODUCT.
1. MANDATORY USAGE & ASSUMPTION OF RISK
SokCurl™ is a soft, heatless hair styling tool made from polyester fabric and elastic components. It is designed for specific styling applications and intended use only. By purchasing and using this product, you acknowledge and agree to the following:
Proper Wrapping Protocol: Hair must be wrapped around the SokCurl™ tool.
The tool itself should not be wrapped around the hair. Improper use may result in tangling, matting, or damage. SokCurl™ is not responsible for hair matting, tangling, or the necessity of cutting hair due to incorrect application or misuse.
Tension & Scalp Health: Users must avoid excessive tension when securing the product. Over-tightening may contribute to scalp strain or traction alopecia. Individuals with thinning hair, pre-existing scalp conditions, or heightened sensitivity should consult a professional prior to use. Use in such cases is at the user’s own risk. SokCurl™ makes no medical claims regarding the prevention or treatment of hair loss.
Moisture Guidelines: SokCurl™ is designed for use on lightly damp or misted hair only. It is not intended for use on soaking wet hair.
Excluded Liability: SokCurl™ is not responsible for breakage, weakening, or irritation resulting from:
Use on excessively wet hair;
Use in combination with chemical treatments or dyes;
Use on compromised or severely damaged hair.
BY USING THIS PRODUCT, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH HAIR STYLING.
2. TOY & SAFETY DISCLAIMER
2.1 Age Restriction: SokCurl™ products are designed and intended for use by adults and individuals aged 14 years and older. Our products are NOT TOYS and are not intended for use by infants or children.
2.2 Hazards: Small parts, elastics, and fabric components may pose a CHOKING OR STRANGULATION HAZARD. Keep all components out of reach of children and pets.
2.3 Supervision: ADULT SUPERVISION IS REQUIRED AT ALL TIMES if the product is used in the vicinity of minors.
3. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOKCURL™, ITS OWNERS, AFFILIATES, PARTNERS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR MISUSE OF THE PRODUCT.
This includes, but is not limited to: Hair breakage, hair loss, scalp irritation, tangling, matting, or emotional distress. SokCurl™’s total liability, under any circumstance, shall not exceed the original purchase price of the product. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
4. ALLERGY & MATERIAL NOTICE
SokCurl™ is made from polyester fabric and elastic materials.
User Responsibility: It is the responsibility of the purchaser to be aware of personal textile sensitivities or allergies prior to use.
Recommended Precaution: We recommend a one-hour trial wear prior to extended or overnight use to test for dermatological reactions. Discontinue use immediately if irritation occurs.
5. INTELLECTUAL PROPERTY PROTECTION
SokCurl™ is a protected trademark. Our proprietary “Prep, Secure, Wrap, Tie” methodology, product design, instructional materials, photography, branding elements, and written content are protected under applicable intellectual property laws.
Unauthorized reproduction, resale, counterfeit distribution, or "listing hijacking" is strictly prohibited. We actively enforce our rights via the Digital Millennium Copyright Act (DMCA) and other legal proceedings.
6. WARRANTY DISCLAIMER
EXCEPT AS EXPRESSLY STATED HEREIN, SOKCURL™ PRODUCTS ARE PROVIDED "AS IS." SOKCURL™ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. INDIVIDUAL STYLING RESULTS ARE NOT GUARANTEED.
7. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
Governing Law: These terms are governed by the laws of the State of Utah.
Binding Arbitration: You agree that any dispute or claim relating to your use of SokCurl™ shall be resolved by BINDING ARBITRATION rather than in court.
Class Action Waiver: YOU AND SOKCURL™ AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless SokCurl™ from any and all claims, damages, or legal fees arising out of the unauthorized or unsupervised use of the product by a minor or any third party to whom you provided the product.
